Please read the following terms and conditions (Terms) carefully. The Terms set out below apply to all customers entering the social media competition (Competition) offered by Montego Pet Nutrition (Pty) Ltd (Montego). If you do not agree to the Terms, do not enter the Competition. Entering the Competition is deemed as your acceptance of the Terms and an acknowledgement of your legal capacity to enter. Entries that do not comply with any of the Terms are invalid and will be discarded.

As listed below, Terms relating to risk, legal responsibilities and liability are important because they limit and exclude liability and legal responsibilities that Montego and other third parties or entities may otherwise be held liable for. As a result of these clauses, your rights and remedies against Montego and other parties are limited and/or excluded. These clauses also limit and/or exclude your right to recover from or make claims against Montego for any potential loss, damages, liability or harm you or others may suffer as a result of you engaging in the Competition.

Entrants are responsible for checking this website for potential updates to the Terms during the Competition period.

1. By entering this Competition, entrants agree to the Terms set out as follows:
2. The Competition entry is limited to people who use their personal account to engage with the Competition accessed on a Montego Pet Nutrition social media platform account during the Competition period.
3. To enter the Competition, follow the instructions provided on the Competition’s relevant social media post (Post). Where entry is by USSD or QR code, the cost of entry, including all subsequent communications, will not exceed R1.50 and will be disclosed in the Post. Montego does not charge any entry fee.
4. Any entrant who uses a social media account that is not their own for the purposes of entry may have their entry disqualified by the Competition account managers.
5. Entrants are responsible for correctly following the Post’s instructions to enter the Competition.
6. Customers may enter as many times as the Competition Post allows. If no number is specified, one entry is permitted per account or person. Deceptive account or entry manipulation methods, such as sock puppet accounts, input-automation scripts, and bot apps, disqualify the entry and the account.
7. Entrants are responsible for purchasing and the cost of purchasing Montego products required by the Competition in the Post. Where the Competition requires the purchase of a Montego product, that product is sold at its ordinary price and no premium is added for entering.
8. Entrants must retain proof of purchase as the winner may be required to present this proof to claim the prize (Prize). If the winner cannot prove all their entries, they will be disqualified, and a substitute winner will be selected.
9. The Competition begins on the time and date detailed in the Post or the Post timestamp. The Competition ends on the date detailed in the Post. Any late entries are invalid. The winner will be determined by independent random draw as set out below.
10. The offered Prize is detailed in the Post.
11. Montego may arrange Prize delivery details with the winner if required, but it is not guaranteed. The winner will be informed if they need to complete any additional documents legally required by the Competition.
12. The Competition is only valid within South African borders. Entrants must be in South Africa when they enter the Competition. If required, the winner’s entry will undergo verification, and Montego will deliver the Prize if they are declared a winner. Failing that, the entry will be disqualified, and a replacement winner will be selected.
13. The winner will be determined by random draw under the oversight of an independent registered auditor, attorney or advocate, who will certify that the Competition was conducted in accordance with these rules and section 36 of the Consumer Protection Act, 2008 read with regulation 11.
14. Montego account managers will notify the winner by way of a message sent to the account of the Entrant. Montego account managers will announce the winner on Montego social media pages (Instagram, Facebook and LinkedIn).
15. Once the Prize is delivered and registered in the winner’s name, the winner takes full responsibility for the Prize.
16. Risk in the Prize passes to the winner on delivery, after which the winner is responsible for the Prize, including its insurance and maintenance. Montego is not liable for any loss or damage arising from the Prize, save to the extent caused by Montego’s gross negligence or wilful misconduct or where such liability may not lawfully be excluded. Nothing in these rules limits the winner’s rights against the manufacturer, importer, distributor or supplier of the Prize under the Consumer Protection Act, 2008.
17. The Prize cannot be transferred or exchanged for cash or for any other goods or services.
18. The Competition and its entry requirements are subject to stock availability. Montego is not responsible for possible stock shortages during the Competition. Stock is delivered to retailers who order the products during the Competition period, in accordance with their specific order preferences and quantities.
19. The Competition is only open to South African citizens who possess a valid South African identity document or passport, or visitors with valid proof of South African residency, who are 18 years old or older.
20. Montego and its processors collect entrants’ personal information only to administer the Competition, verify eligibility and deliver the Prize. Any use for marketing requires the entrant’s separate consent.
21. Personal information is processed securely, is not retained for longer than is lawfully required, and any cross-border processing is conducted in accordance with section 72 of POPIA. Entrants may contact Montego’s Information Officer.
22. The Competition excludes employees, directors, owners, agents, distributors, consultants, suppliers, their immediate family members, or anyone directly connected to or in the employment of participating retailers, Montego, its subsidiaries, business partners, associates and advertising agencies.
23. Montego may invite the winner to take part in publicity, including photographs, for use on its platforms. The winner is under no obligation to accept and may decline without affecting their entitlement to the Prize.
24. Montego may make non-material, administrative changes to these rules on reasonable notice to participants. Montego’s decisions on the conduct of the Competition are final, save that nothing in these rules limits any right a participant has under the Consumer Protection Act, 2008.
25. These rules are prepared before the Competition opens, are available free of charge at montego.co.za and on request from competitions@montego.co.za, and are retained by Montego. Montego Pet Nutrition (Pty) Ltd is the promoter of the Competition and remains responsible for it.
